TermsofService.
Last updated 17 October 2026
These Terms of Service (“Terms”) govern your use of DomeAgent, including the website at domeagent.com.au, the app at app.domeagent.com.au, and the listing pages we host (together, the “Service”). The Service is provided by Dome Technologies Australia Pty Ltd (ACN 702 017 963, ABN 24 702 017 963), trading as DomeAgent (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an agency, you confirm you are authorised to accept these Terms for it.
1. Who can use DomeAgent
DomeAgent is a business service for real estate professionals and agencies. You must be at least 18, and you must only use the Service in connection with properties you are authorised to market.
2. Your account
- Give us accurate details and keep them up to date. We verify your mobile number when you sign up, and each mobile number can verify only one account.
- Your account is for you alone. Keep your sign-in details secure and tell us promptly if you think someone else has accessed your account. You are responsible for activity on your account.
3. Agencies and teams
- Every account works within an agency. On your own, that agency is just you; on an agency plan, it includes the people invited to it.
- An agency's owners and admins control its members, roles, brand kit and billing. Listings created in an agency belong to that agency, and what each member can see and do depends on their role.
- If you leave an agency, you receive a personal copy of the listings you created or were assigned, including their details and generated files. Purchases, allowances and published pages stay with the agency.
4. Listing orders
- Tools are bought per listing. Each order is for one product shown at checkout, such as a single module (Images, Aerials or Video), all three modules, or Concierge. Upgrading a listing credits the value of modules it already has.
- Each product includes the allowances described at checkout, such as a number of generations per photo, aerial images, or seconds of video. Allowances apply to that listing only and can be increased with a top-up. Marketing tools (such as social posts, brochures, the listing page and downloads) are included with any order.
- Prices are in Australian dollars and include GST. We will issue a tax invoice for every payment.
5. Payment and deferred payment
- You can pay when you order, or defer payment for 14 days using a saved card. By choosing to defer, you authorise us to charge that card on the due date. We will remind you before we charge it.
- If a charge is declined, we will retry it, and we may contact you and your agency's owners about the overdue amount. You remain responsible for paying it. We may suspend access to unpaid orders or to the Service until overdue amounts are paid.
- Payments are processed by Stripe. If your agency has a card on file, orders on its listings may be charged to that card.
6. Agency plans
- An agency plan is a subscription charged per seat, monthly or yearly, for each active member of the agency. When a member joins or leaves, the charge is adjusted on a prorated basis. The plan renews automatically until it is ended.
- While the plan is active and paid, members receive the discount on listing orders described when you subscribe.
- The agency owner can end the plan in the app. It ends immediately; any prorated credit for unused time is applied to the agency's billing account. Listings, orders and the brand kit move back to the owner's personal account.
- Enterprise plans are agreed with us directly, and any separate agreement for them applies in addition to these Terms.
7. Discount codes and offers
Discount codes, including a free first-listing code, are single use unless we say otherwise, may be limited to particular products, have no cash value, and may be withdrawn if misused. Each person may receive only one free first-listing offer.
8. Concierge
With Concierge, a DomeAgent team member prepares the listing's images, aerials and video for you. We aim to have it ready for your review within 24 hours of your order, and one round of revisions is included. Turnaround times are a target, not a guarantee.
9. Refunds
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing in these Terms limits them. Beyond those rights, fees are not refundable, but if something has gone wrong, please contact us and we will consider a refund. If an order is refunded in full, access to that order's tools ends.
10. Your content
- You keep ownership of the content you upload or create with the Service, including photos, listing details, brand assets and the outputs generated for you.
- You give us a non-exclusive licence to host, copy, process, transform and display your content as needed to provide the Service, including sending it to the service providers described in our Privacy Policy, publishing listing pages you choose to publish, and saving files to services you connect.
- You must have the rights and permissions needed for everything you provide or use with the Service, including photos, floor plans and property information retrieved from listing portals or other sources for a listing, and the personal information of presenters and other people you add.
11. AI-generated outputs
- Many tools use artificial intelligence. Enhanced and virtually staged images, aerial images, boundary markups, redrawn floor plans, videos and suggested text may contain errors or may not match the property exactly. Boundary lines are indicative only and are not a survey.
- Review every output before you use it. You are responsible for how you use outputs in your marketing and for complying with the laws that apply to property advertising, including the Australian Consumer Law and the real estate agent laws in your state or territory. For example, you should disclose where an image has been virtually staged or digitally altered, and you must not use an output to mislead buyers, tenants or vendors about a property.
12. Listing pages and enquiries
When you publish a listing page, it and its presenters' details are visible to anyone with the link. Enquiries sent through a listing page are made available to the agents on that listing. You must handle enquirers' personal information lawfully, including under the Privacy Act 1988 (Cth) and the Spam Act 2003 (Cth).
13. Services you connect
- DomeAgent works with third-party services, including Canva, Facebook, Instagram, CRM systems and Stripe. Your use of those services is governed by their own terms, and their availability is outside our control. You can disconnect a connected service at any time.
- When you post to Facebook or Instagram from DomeAgent, you are publishing as that Page or account. You must be authorised to post for it, and what you publish must follow Meta's terms and community standards as well as these Terms. A post you schedule is published at that time unless you cancel it first or the account is disconnected.
- DomeAgent is not affiliated with, endorsed or sponsored by Canva or Meta. Canva is a trademark of Canva Pty Ltd. Facebook and Instagram are trademarks of Meta Platforms, Inc.
14. Acceptable use
You must not:
- Give false or misleading information, or create accounts to claim offers more than once.
- Upload or generate content that is unlawful, infringes anyone's rights, or is misleading, defamatory, discriminatory or offensive.
- Use the Service to harass, defraud or harm anyone, or to send spam.
- Attempt to access accounts, listings or systems you are not authorised to access, or interfere with the Service's security or operation.
- Copy, scrape, resell or reverse engineer the Service, or use it to build a competing product.
15. Our intellectual property
We and our licensors own the Service, including the DomeAgent name, logos, software, templates and website content. Subject to these Terms, we grant you a non-exclusive, non-transferable right to use the Service for your business. We may use feedback you give us without obligation to you.
16. Changes and availability
We are continually improving DomeAgent and may add, change or remove features. Some features are marked beta and may change or be withdrawn. We aim to keep the Service available, but it may sometimes be interrupted, including for maintenance or because a service we rely on is unavailable.
17. Suspension and closing your account
You can close your account at any time by emailing us from your account's email address. We may suspend or close an account if it breaches these Terms, has unpaid amounts, or is being used in a way that risks harm to others or to the Service. Where reasonable, we will tell you first and give you a chance to fix the problem. Download anything you want to keep before your account closes.
18. Liability
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by legislation that cannot lawfully be excluded, including the consumer guarantees in the Australian Consumer Law. Subject to that:
- the Service is provided “as is”, and we do not promise that it, or any output, will be error-free or suitable for a particular purpose;
- we are not liable for any indirect or consequential loss, or for lost profits, revenue, opportunities or data; and
- where our liability for failing to comply with a consumer guarantee can be limited, it is limited, at our option, to supplying the services again or paying the cost of having them supplied again. Otherwise, our total liability to you is limited to the fees you paid us in the 12 months before the claim arose.
You are responsible for, and will compensate us for, loss we suffer from claims by third parties arising from content you provide or from your breach of these Terms or the law, except to the extent we caused it.
19. Privacy
Our Privacy Policy explains how we handle personal information.
20. Changes to these Terms
We may update these Terms from time to time. We will change the “Last updated” date above and, if the changes are significant, tell account holders by email or in the app before they take effect. Continuing to use the Service after that means you accept the updated Terms.
21. Governing law
These Terms are governed by the laws of Victoria, Australia. The courts of Victoria and courts entitled to hear appeals from them have non-exclusive jurisdiction.
22. Contact us
Questions about these Terms, and any notice to us, can be sent to hello@domeagent.com.au.
